Randy Mallaber

Attorney Randy Mallaber, originally from Gowanda, NY is a Summa Cum Laude graduate of SUNY Fredonia with a bachelor of science degree in Political Science. He earned his Juris Doctor from Syracuse University College of Law. He is a member of the Erie County Bar Association and has been admitted to practice law in New York State since 2003. He handles matters all across New York State in both State and Federal Court. While he specializes in motor vehicle accidents, he has represented clients in a wide variety of matters including civil rights, medical malpractice, products liability and toxic torts. Randy has extensive experience with accidents involving large trucks and tractor trailers.

Randy grew-up in rural upstate New York where there were “more cows than people.” He spent his youth bailing hay and “doing chores” at the dairy farms near his home. Randy also enjoyed working on cars during his teen years which has afforded him a useful understanding of automobiles. That understanding gives him a special insights when investigating automobile accidents.

Since graduating high school, Randy has fully embraced the city life settling in the City of Buffalo. As a new resident of the “Five Points” neighborhood, Randy enjoys trying all the new restaurants and breweries on offer in Buffalo. Randy appreciates the contrast from his youth growing up in the country where everything was a mile (or more) away, and where he lives now where everything is a short walk away.

Throughout his life, Randy enjoyed hiking, mountain biking and skiing. Randy makes full use of the Ellicottville area by riding the mountain bike trails in the summer and the hitting the ski slopes in the winter. He also enjoys hiking and camping.  Randy has a special affinity for hiking in the High Peaks region in the Adirondacks. He does not limit his exploring in the Adirondacks to just the summer months. He has summited high peaks in both the summer as well as in deep winter. Each season offers different challenges.

After moving to the City Buffalo, much to his surprise, Randy discovered a passion for sailing. On a whim, he went sailing with a friend on a random day and fell in love. Since, Randy has served as a crew member on Wednesday night sailing in the Buffalo Harbor and has raced in several regattas. His favorite regatta to race in is the Lake Erie Interclub Regatta which lasts a week and includes a race leg across Lake Erie from Erie, Pennsylvania to Dover, Canada. While he enjoys racing and the sailing skills it builds, he prefers to pleasure sail either on Lake Erie or in the Caribbean.

Randy is focused on helping people when they find themselves in a difficult situation and says, “My personal view is that we all have a responsibility to do what we can for others. Making a positive difference in someone’s life is very rewarding.” He is passionate about representing people and helping them through the legal process. Typically, a personal injury case is the first time a client has an experience with the legal process in general and civil litigation in particular. It is important that the client is helped to understand each step of the process of litigation and knows what to expect along the way.

A particular passion for Randy is moving the client’s case through the process as quickly as possible. In years past, many attorneys would go by the motto: “the case gets better with age.” As a result, injured clients would wait five or more years for their case to slowly wind its way through the courts. Randy rejects this philosophy. He believes that the best thing an attorney representing a client in a personal injury action is to move the matter as quickly as the facts permit. Once there is a complete picture of the client’s injuries and losses, the best thing an attorney can do for a client is help them get the case to resolution as quickly as possible and not let the case sit on a desk for years. His years of experience has shown him that the sooner a client can put the case behind them, the sooner they can get on the road to a normal life. Randy is committed to helping his clients get there.

Randy accomplishes his goals by thoroughly investigating an accident as soon as the client retains our office to help them.  The investigation can include a plethora of things including canvassing for witnesses, arraigning to have a specialist download the data from the involved vehicles or having a full independent accident reconstruction done in the days following the accident. He is a firm believer that a comprehensive early investigation as warranted by the specific facts of each case places him in position to drive the case forward and force the Defendant, and their insurance carriers, to take his client’s case seriously. While most cases do not require going to trial, Randy has shown through years of experience that the best way to get a client the maximum recovery is to show the Defendants, and their insurance carriers, that he is fully prepared to take his client’s case to trial and verdict. If a fair resolution cannot be obtained by settlement, Randy will take the case to trial.
