No-Fault insurance coverage, also called personal injury protection (PIP), is required by law on New York car insurance policies. No-Fault insurance covers expenses related to the accident—regardless of who was at fault for the crash. The coverage typically comes from the policy of the vehicle you were in during the accident, or from the striking vehicle in a pedestrian or bicycle accident.
You must apply for no-Fault benefits as soon as possible, but no later than 30 days after your accident. Additionally, if you notify the carrier by telephone, you also should send an Application for Motor Vehicle No-Fault Benefits (also called an NF-2 form) within the same 30 day time frame.
Which expenses are covered?
No-Fault insurance provides coverage for several different types of accident-related expenses, including:
- Payment for your medical treatment for accident injuries
No-Fault coverage will pay for medical, hospital, surgical, nursing, dental, X-ray, therapy, rehabilitation needs and medical transportation, as well as other necessary professional health services. - Lost wage reimbursement for your time missed at work
Wages that you would have earned from work had you not been injured are covered under No-Fault. The coverage provides up to 80 percent of your average weekly earnings or up to $2,000 per month, whichever is less, for up to three years. This coverage is often combined and offset with New York State disability benefits. - Reimbursement for other expenses related to an accident injury
Transportation costs to and from medical treatment, as well as other expenses related to your injury that a doctor deems necessary, may be covered by an insurer up to a certain daily limit. It’s suggested that you keep a log of expenses to submit to the No-Fault insurer every 30 days.
