Communication is key after a New York motor vehicle crash.

An experienced attorney may know how to navigate the court system and advocate on the client’s behalf, but it is the client whose name is on the caption. It is the client who witnessed the crash and, because of related injuries, may be experiencing pain and limitations which interfere with daily life.

Someone looking for legal help after a car crash may ask prospective attorneys: “How will you keep me informed about the progress of my case?” or “What level of participation will be required from me?”

Attorneys are required to keep their clients apprised of important case developments and consult with them about the best way to achieve the client’s objectives.

When Someone Is Seriously Injured

Someone seriously injured in a New York motor vehicle crash will generally seek maximum compensation for pain and suffering. which generally requires a showing of “serious injury.” The attorney must accordingly have some idea where the person is being treated so that medical records—often key evidence—can be requested, assembled, and organized. Moreover, the client may have an important perspective when it comes to investigating how the crash happened. This can include gaining access to non-party witnesses or locating surveillance cameras which may have captured the crash. The client may also be able to connect the attorney with friends and family who are well situated to explain how the crash altered life. These are sometimes known as “before and after witnesses.”

Communication is a two-way street. It is the attorney who, once retained, will deal directly with the at-fault motorist’s insurance company, and generally act as the client’s “agent” when it comes to moving the case forward through the insurance claims and litigation process. The attorney is duty-bound to comply with the client’s reasonable requests for information about how the case is progressing. That is something the client deserves.

Importance Of Client Participation

The client’s participation in this process may appear to ebb and flow depending on the stage of the case, but it is always paramount. The client will certainly feel involved at a deposition when questions are answered under oath in the presence of the attorneys and a court reporter. The client may feel less involved during a court conference that is reserved for attendance by the attorneys only. No matter the perception, the attorney is at all times acting as an agent of the client, who is the principal. In other words, the attorney is an extension of the client, always looking out for the client’s best interests.
