$2.4 Million Settlement Reached In Wrongful Death Of NY Pedestrian

A settlement has been reached in the wrongful death lawsuit filed on behalf of a Derby, New York, man who was killed in October 2010 when he was struck by a school bus while crossing the street. According to reports from the Buffalo News, Lake Shore Central Schools and the Evans-Brant Central School District will pay the wife of the victim $2.4 million.

Court documents show that the 49-year-old hospital technician and volunteer firefighter was hit at 6:55 a.m. at the intersection of Eerie Road and Revere Drive. The man was attempting to catch a bus to work when he began walking across Eerie Road at the designated crosswalk.

At the same time, a bus driver was accelerating in an attempt to make it through a yellow light and reportedly didn’t see the man at the crosswalk. The victim died of crushing injuries at the scene.

State Supreme Court Justice Gerald J. Whalen approved the hefty settlement on Thursday, just two weeks before jury selection was set to begin for a trial in the case. Court documents show that after court costs and attorneys’ fees, the victim’s wife will receive $1.6 million in compensation for future emotional and financial hardships she and her family may face.
